Terms and Conditions

Welcome to EAZTA. These Terms and Conditions ("Terms") govern your use of our services, including (1) EazTa, an AI-powered phone ordering service for restaurants, and (2) OnIt (also referred to as EazTa OnIt), an AI-powered voice reminder assistant. By using either service, you agree to these Terms.

EAZTA is a sole proprietorship operated by Pascal Bonifay, located at 1060 Cochran Avenue, Apt 2, Los Angeles, CA 90019.

1. Service Description

EazTa provides an AI-powered phone ordering system that allows customers to place food orders at participating restaurants via phone call. EazTa includes:

• AI-assisted phone order taking
• SMS delivery of menus and order confirmations upon request
• Order history and preference tracking for personalized service

OnIt provides an AI-powered voice reminder assistant. OnIt includes:

• Voice-based reminder creation: users call our toll-free number and verbally describe reminders they want to receive
• Automated outbound voice callbacks at the scheduled time to deliver each reminder
• SMS delivery of reminder content and operational updates upon explicit user request or opt-in
• User-configurable callback behavior (mode, default time, quiet hours)

2. Eligibility

You must be at least 13 years old to use our services. By using either service, you represent that you are at least 13 years of age and have the legal capacity to enter into these Terms.

3. User Conduct

When using our services, you agree to:

• Provide accurate information when placing orders or creating reminders
• Not use the service for any unlawful purpose
• Not abuse, harass, or misuse the AI system
• Not attempt to disrupt or interfere with the service
• Not create reminders containing illegal content, threats, or content directed at harming others

4. Orders and Payments (EazTa only)

• All orders are subject to acceptance by the participating restaurant
• Prices, availability, and menu items are determined by each restaurant
• Payment is collected by the restaurant at the time of pickup or delivery
• EAZTA is not responsible for payment processing or disputes with restaurants

5. SMS Communications

Consent: You consent to receive SMS messages from EAZTA when you (a) verbally request them during a call (e.g., asking for a menu to be texted, or asking OnIt to "text me" your reminders), or (b) text the keyword START to our OnIt toll-free number to opt into SMS-based reminder delivery.

SMS terms:

• Messages are sent only when you explicitly request them or have opted into a recurring stream you set up
• Message frequency depends on your requests and the reminders you create
• Message and data rates may apply based on your carrier plan
• Text STOP to opt out of future messages
• Text HELP for assistance
• Supported carriers include major US carriers (AT&T, Verizon, T-Mobile, etc.)
• Service is available in the United States and Canada only

6. Intellectual Property

All content, features, and functionality of the EAZTA services, including but not limited to text, graphics, logos, voice personas (such as Grace), and software, are owned by EAZTA and are protected by intellectual property laws.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:

• The services will be uninterrupted or error-free
• The AI will always understand requests correctly
• All menu information will be completely accurate
• Orders will always be fulfilled by restaurants
• Reminders will always be delivered at the scheduled time (e.g., due to user phone unavailability, carrier issues, or service interruptions)

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EAZTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Errors in order processing
• Restaurant food quality or safety issues
• Delays in order preparation
• Missed, delayed, or undelivered reminders
• Consequences of relying on a reminder (e.g., missed appointments, missed medications)
• Technical failures or service interruptions

OnIt is a productivity aid, not a medical, safety, or legal-compliance system. Do not rely on OnIt for time-critical reminders that affect your health or safety.

9. Restaurant Relationships (EazTa only)

EAZTA acts as a technology provider for participating restaurants. We are not responsible for:

• Food preparation, quality, or safety
• Restaurant business practices
• Accuracy of restaurant-provided menu information
• Order fulfillment by restaurants

10. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page. Your continued use of the services after changes constitutes acceptance of the modified Terms.

12. Termination

We may terminate or suspend your access to the services at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
